State governments cannot conduct entrance examinations: Supreme Court

Supreme Court has ordered that state government cannot conduct entrance examinations for medical courses.
 
On 11th the Supreme Court has pronounced that a National Eligibility cum Entrance Test (NEET) should be held throughout the country to admit students in the MBBS and BDS courses.  The state governments and private medical colleges filed a petition against this verdict in the Supreme Court. The Supreme Court rejected this petition.
 
The Central Government had requested the Supreme Court to reverse its earlier order for the academic year 2016-2017 which paved way for the state governments to conduct entrance examinations for MBBS and BDS courses. The Supreme Court had mentioned that this matter will be enquired later and pronounced that the NEET should be conducted in two phases. The first phase of NEET was to be held on 1st May and the second phase is to be held on 24th July. As advised, the CBSE conducted the first phase of NEET on 1st May.
 
Kashmir, Karnataka, Andhra, Telangana and Uttar Pradesh state governments and some private medical colleges filed a petition in the Supreme Court to bar this NEET since the village students will be affected. In the petition, it was mentioned that the state governments should be allowed to conduct entrance examinations.
 
This petition came for hearing before a bench of Justices A R Dave, Shiva Kirti Singh and A K Goel. 
 
After hearing the petition, the Supreme Court refused to modify its order passed on April 28 by which it had directed the implementation of the NEET for 2016-17 academic year and dismissed pleas filed by various state governments and private institutions.
 
The Supreme Court order mentions the following points:
 
The state governments or colleges cannot conduct separate entrance examinations.
 
All the state governments should admit students based on the NEET.
 
The students who were unable to attend the NEET on 1st  will be permitted to attend the second phase NEET.
 
The students who have attended the NEET on 1st May, if interested can attend the second phase NEET which is to be held on 24th July. If they attend, marks obtained in the first phase NEET will not be taken into account.
 
If necessary, the central government and CBSE can change the date of the second phase NEET.
 
Special provisions for reservation of any category nor rights of minority  will be  affected by NEET.
 
To ensure total credibility of the examination to be held by the CBSE, the Oversight Committee appointed by this court shall also oversee the NEET-II examination to be conducted by the CBSE.
