Aadhar may be used by telecom companies and private players, Jaitley

Arun Jaitley, Finance Minister recently said that it is agreed and allowed to restore compulsorily linking biometric ID Aadhar for mobile phone and bank accounts. However, he did not mention about the government implementing a new law in this regard.

Last month, the Supreme Court had upheld Aadhar validity, but new restrictions were imposed as to the use of the ID by private players such as telecom operators.

Speaking about this, Jaitley said this is a notable judgment as the court has agreed to the fact that there prevails legitimate state aim with Aadhar.

He adds that Aadhar is not a citizenship card, but a program. There is a system where the government provides a lot of money extended as support. This is the ultimate aim of Aadhar.

Most of the Aadhar activities are upheld, as per the Supreme Court order.

Those that are not upheld belong to 2 categories. The first is the principle of proportionality where Aadhar will help the cases and abide by appropriate law.

Through law or contract, it is possible to authorize use of Aadhar. According to Section 57, private companies cannot use the Aadhar for any kind of verification.

According to the Finance Minister, there is a legal way by which you can restore the procedure of linking Aadhar and mobile phones or bank accounts.

You can still do it if you follow the requisite provision of law and according to the necessities. He added that there are no plans to implement a law in the parliament.

Based on the principle of proportionality, a few areas such as income tax are allowed to make use of Aadhar linkage.
