As informed earlier, the state government of Tamil Nadu has released the official order permitting the shops and other commercial/rest establishments to function 24-hours a day.
The Finalization of the Legal Act pertaining to shops and establishments were finalized by the central government in the year 2016. Accordingly, the cinema theaters, hotels, shops, banks, and various other commercial establishments can function 24-hours-a-day throughout the week of 7 days!
It has been informed that this Act can be modified in different state governments according to the conditions and requirements and be implemented.
In this situation, with the objective of achieving substantial industrial growth and create more job opportunities, the state government of Tamil Nadu has released the Government Order to allow the shops/other establishments to function 24-hours-a-day throughout the 7 days of the week.
However, a lot of conditions and provisions are included in this order. Each employee must be given his/her weekly ‘off’ day during the week. The essential personal details of the employees working must be kept at an accessible location.
An employee can be permitted to work up to a maximum of 8 hours per day and 48 hours in a week, In case of additional work, overtime wages must be paid to the concerned employees.
If employed for additional time, the total working hours of the employee should not exceed 10.30 hours in a day or 57 hours in a week.
It will be a violation in case the employees are asked to work more than the above-stipulated conditions and the concerned supervisor or company will be penalized and punished.
Women workers should not be allowed to work after 8.00 PM. If necessary, they may be employed only after due written and signed approval from the concerned woman employee.
The women employed must be provided with high-level security from 8.00 PM to 6.00 AM and the required transport facility must be arranged by the employer. The employees must be provided with basic amenities such as toilets, rest-rooms, etc.
