The Supreme Court has announced that it is very essential to link the PAN card with the Aadhar card details.
There are several petitions pending enquiry about Aadhar cards. The Supreme Court had announced that a special constitutional bench will enquire all these petitions. The enquiry was completed by the special constitutional bench on 26th September last year The verdict was announced on 26th September.
As per the verdict, it was mentioned that Aadhar is a legally valid document n=and resource but at the same time, it may not be required as essential for certain government schemes and also for new telephone connections.
2 IT payers, Shriya Sen, and Jayashree Satputhe filed the Income Tax returns for the financial year 2018-19 without linking their Aadhar card details. The Delhi Court gave the verdict this IT returns must be accepted and processed as it is not essential to link Aadhar details with PAN cards.
The central government appealed to the Supreme Court against this verdict. A bench of judges including A. K. Sikri and Abdul Nazir took up this enquiry.
The bench gave the verdict on the enquiry yesterday (Wednesday, 6th February). It mentioned:
‘The Delhi High court had given the verdict that filed IT returns need not to include Aadhar card details. However, as per the Income Tax Act 139-A, it is essential to link Aadhar card details with the PAN card. Further, the IT filing has been done after the given deadline.
Further, the IT payers have expressed that there is no facility to link Aadhar card details with PAN card especially while filing the Income Tax returns online. Thus, they themselves have expressed that it is indeed essential to furnish Aadhar card details with this.
So, it is reconfirmed that it is essential to link Aadhar card details with PAN Card.’
