“All-correct EC certificates are tough to produce”

The state registration department has an inacceptable statement that it cannot provide any EC certificate (Encumbrance certificate) without any fault. As well known, an EC certificate is the base document describing the current status of any immovable property. This certificate is supposed to have the comprehensive property details, owner details, etc so that it can be used for mortgage purposes.

Recently, a landowner purchased a property from one other person whose EC did not contain any ownership details at all. On his anticipatory bail petition, the issue was enquired to the inspector-general for which he had a shocking reply to the Madras high court. “EC certificates are prepared by referring to the survey numbers, extent, period, boundaries etc. In case of any mismatch in the survey number, the EC certificate will not reflect the encumbrances related to the property,” he stated. This irresponsible reply led to an in-depth debate for quite some time.

Replying to this answer from the inspector-general, Justice S.Nagamuthu said that it is entirely unacceptable to complain on the relevance of survey number in this era of computer-dependent world.
