Highlights of the new Motor Vehicles Bill

Finally, the Motor Vehicles Bill is passed by the government. According to the bill, there is very heavy penalties imposed towards violation of traffic rules. This includes fine amount of whopping Rs 10,000 if the commuter does not leave way for emergency vehicles. And there may be penalty imposed for driving in spite of disqualification, say officials.

The bill had been waiting for approval from the Rajya Sabha for long. It in fact got lapsed in the 16th Lok Sabha.

Now, the Motor Vehicles Amendment Bill is approved under the cabinet headed by PM of India, Narendra Modi. This bill mainly imposes penalties towards traffic rule violations, stress sources.

As far as road safety is concerned, there are very stringent rules proposed towards scenarios including
  • Juvenile driving
  • Driver driving without holding license
  • Driving in dangerous manner
  • Drunk and drive
  • Excessive speed than permitted limit
  • Excessive loading of vehicle than allowed, etc.
On Monday, the cabinet has approved the bill and it further agrees to charge up to Rs 10,000 if the commuter fails to leave way for emergency vehicels to pass through, and the same amount shall be charged for drivers who drive in spite of disqualification.

These are proposals incorporated as per the transport ministers’ recommendations from 18 different stages. The Standing Committee of Parliament has also agreed to the same.

In case of over speeding, penalty of about Rs 1000 to Rs 2000 shall be imposed.

For those who drive without insurance, the penalty amount will be Rs 2000 and for those who drive without wearing helmet, the penalty will be Rs 1000 plus license suspension for 3 months.

For cases pertaining to juvenile norm violations, the owner or guardian will be held guilty in such cases. Also the vehicle registration will get cancelled in such cases. It will further attract a sum of Rs 25,000 as penalty plus imprisonment of up to 3 years will be applicable in addition to cancelling registration of motor vehicle.

For cases of traffic violations, the penalty quoted will be Rs 500 while the same was earlier Rs 100. For cases of disobedience towards authority orders, the penalty will be Rs 2000 while the same was Rs 500 previously.

Rs 5000 will be charged for cases where unauthorized vehicle usage without having proper license is caught. And the same amount will be applicable in case of driving without license. For those who drive in spite of disqualification, the penalty will be Rs 10,000.

From the previous Rs 5000, the e penalty imposed for driving in dangerous manner will now be increased to Rs 10,000. A sum of Rs 10,000 will be applicable for drunken driving.

In case there is violation of licensing conditions, there may be penalty charged up to even Rs 1,00,000. For overloading of vehicles, the penalty may be of the range Rs 20,000.

Rs 1000 will be imposed for driving without wearing seat belts. And the same amount shall be quoted for driving two wheelers without helmets. Also, the license of such commuters will be disqualified for a period of 3 months.

There is double the regular charge towards offices where the commuter violates authority’s instructions. Furthermore, the proposed law stresses on the need to strengthen training process for driving.

There is good Samaritan guidelines in order to facilitate victims of road accidents.

There will soon be motor Vehicles Amendment Bill submitted at the upcoming parliament session, says Nitin Gadkari, the Minister of Transport and Highways.

It is to be noted that the Motor Vehicles Amendment Bill has got passed at the Lok Sabha. It was back in April 2017 that it was originally introduced.
