All Legislative Assembly Members belonging to the ruling as well as the opposition party can participate in the confidence voting.
Can the Legislative Assembly member avoid participating in the confidence voting?
Independent members can vote for the party of their preference. However, party assembly members will vote as ordered by the party whip.
How is the confidence voting conducted?
All the legislative Assembly Members must take their seats. The Assembly doors would then be closed. The secretary of the State Legislative Assembly would then initiate the procedure for confidence voting. The 234 MLAs would be seated in 6 groups. The secretary will ask the group members in support of the ruling government to stand up. After this, those who against the ruling government in the same group would be asked to stand up. Next, the members who are neutral on this issue would be asked to stand up.
Thus, all the 6 groups will be asked to convey their preference. Their names would be noted and the votes will be counted in the 3 options – for, against, and neutral.
Once all the 6 groups finish this operation, the votes will be counted in each category and the results would be announced.
Does the speaker of the assembly have the right to participate in the confidence voting?
In case the only a single vote is required to defeat the government, the speaker will be asked to vote as per his preference.
Who will announce the results?
The speaker will announce the results. Then, a report will be prepared on the confidence voting conducted and sent to the state governor.
