Loyola College one of the first colleges in Chennai has been restrained from collecting excess fees from the students by the High Court. Loyola College is a government aided college. V Amalraj, Tamilnadu Catholic Minorities Welfare Association, Choolaimedu had filed petition alleging that the college had been collecting around Rs 10000 per annum from the students who joined in Science stream against government stipulated fee of Rs 500. His argument was that college being assisted monetarily by the government should charge only government fixed fee. Taking cognizance of the allegation the director collegiate education had informed the court that special audit of accounts would be undertaken at the college. Interestingly the college had not denied collection of excess fee in their counter field in the court.
The first bench comprising Chief Justice H L Gokhale and Justice V Dhanapalan observed in their interim order that the college starting from the coming academic year the college cannot be permitted to charge excess fee, about which a clear allegation is made in the petition, to which there is no specific denial. In the circumstances, the petition is allowed.
