In a recent order, the state government of Tamil Nadu has announced that the pillion riders in the 2-wheelers must wear the helmet and failure to adhere will entail penalty payments.

The state government of Tamil Nadu has been taking various initiatives in order to bring down the road accidents.
There have been 15601 road accidents till July this year exclusively involving 2-wheelers. So far, 2467 people have lost their lives due to 2-wheeler accidents. Out of this, the number of people who died because of failure to wear the helmet is 1811.
So far, 2.14 Crores 2-wheelers have been registered by the Department of Transport. This constitutes 84% of the total number of 2-wheelers in the state of Tamil Nadu.
It has been constantly advised and recommended to wear helmets while driving/riding 2-wheelers and seat-belts while driving/riding 4-wheelers (cars) in order to avoid loss of lives. As per the Motor Vehicles Act 1988, Section 129, the 2-wheeler driver and the pillion rider, both must wear helmets while riding.
The Chennai High Court has also insisted on implementing the same. Hence, it is mandatory for the 2-wheeler driver and the pillion rider to wear helmets. Failure to wear the helmet while driving will entail a penalty payment as per the Motor Vehicles Act 1988, Section 177.
