New regulation: encumbrance certificate to be given only online (from 2nd Jan)

The present procedure of obtaining encumbrance certificates related to property registration by visiting the registrar office comes to a close from 2nd January.

The Department of Registration has announced that henceforth, encumbrance certificates will be issued only online.

So, the procedure to obtain encumbrance certificate only online will come into force from 2nd January.

The encumbrance certificate is very essential in order to access the complete details of the previous transactions between the people who buy/sell immovable property assets such as houses/flat/s/plots.

Presently, the facility to access the details of the previous transactions is available on the official website of the Department of Registration. However, only the encumbrance certificates which were obtained directly by submitting an application are entertained and valid while scrutiny/enquiry is carried out by the banks or courts.

In this situation, all the tasks and activities in different official procedures have been converted to the ‘online’ mode from 10th December. So, after making payment online and giving the QR Coed details, it is possible to get the encumbrance certificate and copies of other related certificates/documents.

The latest order released by the Department of Registration

As it has become a mandatory procedure, the earlier procedure of applying directly for obtaining encumbrance certificate in the registrar offices is being given up. Only for the documents related to the period before digitalization can be obtained by direct applications.

Inspector General J. Kumarakurubaran, Head of the Department of Registration, explained in this regard:

‘There are no changes in the process of accessing free information regarding the encumbrance/transaction details of the relevant property. This service, inaugurated by the former Chief Minister of Tamil Nadu, J. Jayalalithaa will never be withdrawn.’
