- Society registration process was introduced mainly for the benefits of the society members on essential aspects such as education, health and employment.
- The Society Registration Act, 1860 was introduced which allow the registration of entities generally involved in the above benefits of society.
- It provides for the registration of literacy, scientific and charitable societies.
- Society Registration is the best business for small traders and merchants.
- The main aim of Society registration is to serve society and not to earn a profit.
MoA
Society formed by memorandum of association (MoA), where a minimum of seven or more members are present and these members are associated with any literacy, scientific or charitable purpose. MoA has to be filled by Registrar of societies.
Documents required for Society Registration:
- Affidavit regarding ownership and NOC for the registered office of the society
- MoA signed by founding members, with a duplicate
- Rules and Regulations, signed by founding members, with a duplicate
- Name, Address and occupation of all members along with their signatures
- Electricity/Water bill
- Address proof of all members
- Copy of property papers
- Landlord NOC (No Objection Certificate)
Why Society Registration is required?
A Society formed by formed by seven members or more member for the following reasons :
- For Promotion of Science
- For Promotion of Literature
- For Promotion of Fine Arts
- For Foundation/Maintenance of Libraries or Reading Rooms
- For Foundation/Maintenance of Public Museum or Galleries
Procedure for Society Registration :
Society Registrations are basically approved by the State government through the registrar of Societies of each state.
Hence, the rules and regulations vary slightly from one state to another.
Registration can be done in two parts :
- Memorandum of Association
- Rules and Regulations of the Society
Memorandum of Associatation (MoA)
The MoA includes several clauses like name of the society, address of registration office, the object for the formation of society and detail of members who want membership.
Rules and Regulations
- The Rules and Regulations have certain questions like-
- How is membership and subscription to be obtained to the society?
- What rules and regulations govern the society and its members?
- How are meeting to be organised?
- How will legal matters be settled? And so on.
These rules and regulations, when formulated, need to be signed by three office bearers of society (Chairman, President and Vice-President or secretary and the President, as applicable.)
Note
- Before applying for registration, there is a need to ensure that the clause mentioned in both MoA and rules are discussed and approved by the members.
- All the documents mentioned above are required to be submitted in duplicate, together with the required registration fee.
- If the Registrar is satisfied with the application for society Registration, the Registration would certify to deem the society to be registered.
