Local body elections will be held in April- SEC tells HC

Tamil Nadu State Election Commission’s advocate told the Honourable High Court that the local body elections will be conducted by April.
 
On behalf of DMK party, a case was filed in the Madras High Court stating that sufficient seats were not allotted to ST candidates.
 
Judge N Kirubakaran who enquired in the case ordered on 4th October 2016. He said: The notification regarding the local boy elections has not been done with the accordance of Tamil Nadu Panchayat (Election) Rules. Hence I am cancelling the election notification. A new notification adhering to the rules should be issued and elections should be conducted by 31st December.  
 
Tamil Nadu State Election Commission and Tamil Nadu government had filed appeals against this judgement separately.
 
The appeal came up for hearing before the High Court Division Bench Judges.

Tamil Nadu State Election Commission’s senior advocate appeared and said: It has been decided to complete the local body elections by the month of April. In the order issued by Justice N Kirubakaran, it was mentioned that a person with a criminal background should not be allowed to contest the elections but it is very difficult to take action in this matter. In connection with, a full day is required for argument. Hence I request to adjourn the case for five weeks.
 
The Judges refused to accept this demand. The Judges said: We are posting this case to 31st January. You can argue on that day.
 
A senior advocate who speared on behalf of DMK argued: The orders passed by the single judge N Kirubakaran is in order. When people who have criminal backdrop, inform about this in their nomination paper the same should be uploaded in the website and make it known to the people. The order passed by the single judge should not be cancelled.The judges who accepted the argument adjourned the case.
