What will happen after the disqualification of MLAs?

Former Election Commissioner, Mr. Naresh Gupta, informed that the decisions regarding disqualifying elected members can be taken only by the Legislative Assemblies and the Courts.

He explained what will happen after the recent disqualification of 18 MLAs from the Tamil Nadu State Government Legislative Assembly. He observed that he had not approached any similar problems in his career. This instance does not fall into any kind of jurisdiction. If the Speaker exceeds the measures allowed within the jurisdiction, only the court can take any decision on this.

Is it possible to prove majority in the legislative assembly while the enquiry is in progress?

In case there is an objection to the High Court verdict, there is an avenue to appeal to the Supreme Court. This is already in vogue. So, I believe the status quo will continue.

This, indeed, is a very confusing situation. It is not possible to give an opinion. Similar problems have occurred several times in the Northern States. However, the court is the only authority to decide on such issues.
