The USA makes H1B Visa Regulations more stringent

The US government has imposed more stringent regulations for the issue of H1B Visa to the foreign employees.

This has led to the Indian employees in IT industry facing extreme hardships.

While campaigning during the Presidential elections, Donald Trump strongly advocated buying only American products and giving jobs on priority only to Americans.

Right from the start when he assumed office as president, Trump has been initiating activities giving priority to Americans in job opportunities. Further, he has imposed various stringent regulations on H1B Visas issued to foreign employees.

The provision was given that H1B Visa can be extended in cases where the green card has been applied till it was issued which would facilitate permanent stay in the USA. However, the USA government has blocked this provision in a recent order.

In this scenario, the US government has gone ahead and imposed further restrictions on issue of H1B Visas, As per this, the details of the foreign employees such as the academic qualifications, the nature of his job, and his skill or that job should be given along required document proofs.

The 3-year H1B Visa issued to employees working for a 3rd party has been stopped, Instead, it will be issued only up to his contract period for the job. After that, it has to be renewed every time, the tenure of the employee gets extended.

The stage was set for the Visas for this year to be issued from 2nd April for this year, However, this recent order is expected to create a lot of hardships for the foreign employees working in the USA. More particularly, it is expected that the employees in the IT segment – mostly Indians – would be greatly affected.

H1 B visas are being issued by the USA to facilitate people from different countries to pursue higher education and working in the USA. The Visa is valid for 3 to 6 years. Till the individual gets a green card, he/she can get this H1B Visa extended regularly to continue working in the USA.

Most employees in IT segment use the H1B visa to go to the USA and work. In fact, it is noteworthy that more than 50% of the total H1B Visas issued are for Indians.
