There are going to be stringent restrictions in the selection process for all the H-1B petitioners.
According to the latest update put up by Fragomen – International Immigration Firm, it is said that the 2011 proposal by DHS is likely to be revised. This will demand the H-1B petitioners to preregister for H-1B cap lottery. Only those who have obtained the cap numbers shall be able to submit cap petitions. A priority system of allocation for H-1B cap numbers is likely to be set up. This will prioritize the highly-paid and the skilled atop, abiding by executive orders from the President Trump’s ‘Buy American, Hire American.’
In an update made in the semi-annual regulatory agenda, DHS has made this announcement. It is likely that there may also be changes in the H-1B wages.
Until February 2018, there is no schedule for announcement regarding changes in H-1B cap. When these are announced under the standard process for Notice and Comment that consumes several months usually, the changes might not be possible within the given timeline.
