Problems to be encountered in case PATTA (the sale deed) for the bought land/plot is not properly registered!

When buying fixed assets such as land or house or flats, the name of the buyer must be registered as per the procedure in the Office of Tahsildar by the owner with his/her name duly registered.

This is known as ‘Patta Transfer’ (‘Sale Deed Transfer’). If the name of the new owner is not properly registered after buying, the name of the previous owner will continue in the register in the concerned sale deed!

While changing the name of the ownership, take care of the change of name in the sale deed of the registration - this is very important!

Here is a small list of problems to be faced in case the name is NOT changed in the PATTA (Sale Deed):

  • If you have not changed the name in the PATTA (sale deed), the previous owner can claim that the property is still his/hers and proceed to sell it to someone else!
  • As such, in case the previous owner had been paying all the related charges and taxes, he may even claim the property to be his/her own!
  • In case the present owner (without proper PATTA or sale deed) needs to sell this property, problems will be encountered.
  • In case the PATTA (Sale Deed) is not registered properly, the new owner cannot claim rights for the property as the name has NOT BEEN CHANGED in the sale deed!
  • In case the previous owner dies, (with the concerned property PATTA (sale deed) still under his/her name), the new owner will face a lot of hardships including a lot of unnecessary travel and procedural difficulties!
